These terms and conditions set out the basis on which you buy from us and we sell to you, turfgrass and other products through our website "emeraldlawns.ie". When you buy from us to must agree to accept these terms and conditions in full and they then form a legally binding agreement with us. You should read these terms and conditions in full before accepting them and placing an order with us because they affect your rights and liabilities.

1) Definitions and basis of sale

a. In these terms and conditions, the following definitions apply:

Emerald Lawns (Ireland) Ltd (Company number NI043956) is referred to as “the company”. Registered & correspondence address: 45 Point Road, Limavady BT49 0LP

A customer buying turfgrass and other products through emeraldlawns.ie or from Emerald Lawns (Ireland) Ltd is referred to as “the customer”. Delivery means delivery by the company or any subcontractor employed by the company directly or indirectly.

b. Any placement of an order by the customer via emeraldlawns.ie signifies the customer’s acceptance of these terms and conditions in full.

c. These terms and conditions can only be varied by a Director of the company in writing.

2) Ordering and payment

a. All prices quoted on the company's website include delivery to an address in the county specified by the customer. If the address provided subsequently proves to be incorrect, e.g. in a different county to that specified by the customer, an additional prepayable charge of £60 or €70 per pallet must be made for a rescheduled delivery on a new date and the company will not accept responsibility for any consequential deterioration in the quality of any perishable goods due to this rescheduled delay.

b. Any order amendments must be received from the customer in writing by 5pm two working days before the day selected by a customer for delivery. Amendments are not accepted by telephone. The company can be contacted for this purpose either by email (info@emeraldlawns.ie), or by recorded delivery to 45 Point Road, Limavady BT49 0LP. Any increase in price must be prepaid by any deadline quoted by the company, in addition to an administration charge of £15 or €20.

c. Orders can only be accepted by the company to a delivery address specified by the customer where there is adequate safe access for delivery with heavy goods vehicles (as determined by the sole discretion of the delivery driver). In the absence of such access, the company reserves the right to refuse or cancel orders without notice or any refund and the ordered goods will subsequently be made available for collection by the customer from an alternative address determined and advised by the company in writing. The company will not accept responsibility for any consequential deterioration in the quality of any perishable goods due to this.

d. Any advice and information given by the company relating to the characteristics and suitability of its products for particular applications is for guidance only, and accordingly no warranty is given, whether express or implied, as to quality or fitness for purpose.

e. The company has a policy for cancellation of orders, as detailed below.

3) Turfgrass supplied

a. All turfgrass supplied will be cultivated turfgrass, which has been sown and maintained to produce a strong, healthy sward and is classified as "perishable goods". Measures will be taken by the company during the growing period to control weeds, diseases and pests. The turfgrass cannot be guaranteed to be completely free of all weeds including Poa annua (annual meadowgrass) as these can come in to turfgrass at any time through seeds borne on air as well as in soil. Turfgrass, as a natural and growing field product, will also be subject to some variation and so absolute consistency within and between orders can similarly not be guaranteed. Consequently from the time of delivery, it's condition and quality are the customer's responsibility and therefore after this time, the company will have no further liability for any loss or damages connected with its use.

b. The company may from time to time vary the seed mixtures used to grow their turfgrass. Where such variation does not materially affect the suitability of turf for indicated uses, such variation will not constitute grounds for any claim by the customer.

c. The size, weight and measure of turf rolls quoted by the company may vary due to turfgrass being a natural field product.

5) Delivery

a. The customer, or their representative (an adult - 18 years old or more) should be present at the delivery address on the selected date to receive and sign the proof of delivery form for all products supplied, In the event that this is not the case, the delivery will be made at the customer's risk and the company will have no further liability for any loss or damages and consequently we cannot accept any responsibility in relation to the damage of goods and/or any shortages of quantities delivered.

b. Delivery and placement of palletised products will be to closest point to the address specified by the customer that the delivery driver deems as suitable, safe and accessible for their heavy goods vehicle to be parked and off-loaded with a tail lift and a manually operated pallet truck which will only operate on smooth (non-gravelled), solid, level surfaces. In the absence of a suitable location, the company reserves the right to refuse or cancel orders without notice or any refund and the ordered goods will subsequently be made available for collection by the customer from an alternative address determined and advised by the company in writing. The company will not accept responsibility for any consequential deterioration in the quality of any perishable goods due to this. N.B. If the driver is instructed to access onto private property and they consent, we cannot accept any responsibility for any resultant damage caused to the property. Also please note delivery drivers are unable to physically carry goods e.g. up paths or to rear gardens.

c. The company will endeavour at all times to deliver turfgrass and other products on the date specified by the customer in an accepted order. Where, however, due to circumstances beyond the company’s reasonable control, delivery is delayed, the company will endeavour to rearrange the delivery time and/or date for as soon as it is possible and will not be liable for any damages resulting, nor will this be accepted as grounds by the customer to cancel the order.

d. The company will not accept liability for damages or injury caused to property or persons during delivery. It is the responsibility of the customer to alert the company to any potential delivery issues for heavy goods vehicles which would be offloaded with a tail lift and a manually operated pallet truck which will only operate on smooth (non-gravelled), solid, level surfaces when placing an order, so that the company has the opportunity to assess in advance of processing the order whether the delivery might be achievable or not . If an order has been placed by the customer and then normal delivery is subsequently determined by the delivery driver to be unachievable for reasons which were not specified in writing to the company when placing their order, the company will endeavour to make the delivery in another way or at another time, with an additional prepayable charge of £60 or €70 per pallet and we consequently cannot accept responsibility for any deterioration in the quality of the perishable goods due to this rescheduled delay. In the absence of any suitable access (as determined by the sole discretion of the delivery driver) the company reserves the right to refuse or cancel orders without notice or any refund and the ordered goods will be made available for collection by the customer from an alternative address determined and advised by the company by email.

6. Any problems

a. The company’s aim is always to give complete satisfaction to the customer. However the customer must inspect & check the goods before accepting delivery. Any defects, discrepancies, damage or any other issues must be documented by the customer or their representative (an adult - 18 years old or more) on the "proof of delivery" form (failure to do so will invalidate any potential claim), and then he/she should contact the company by email to info@emeraldlawns.ie within 24 hours of the delivery. If turfgrass or other goods received are damaged or defective in any way, then the company will refund the customer or provide replacement products, however the goods may need to be returned to the company (at the customer's expense) or other evidence (as accepted by the company) supplied in order for a customer to receive a refund or replacement. Please refer to the company’s Returns and Cancellation Policy below.

b. In the event of goods supplied being damaged or defective, or in the event of other complaint, the company’s liability will be limited to the value of the price paid by the customer and will not extend to any "consequential loss".

d. The company will not be responsible for any defects in turfgrass supplied arising from inadequate site preparation, laying or maintenance of the turfgrass by the customer.

e. The company will not be responsible for any failure of a product to meet its specification or to perform as it should due to manufacturers’ instructions not being followed in full.

These terms and conditions will be governed by Northern Irish law and any disputes will be resolved by the Northern Ireland courts.

Returns and Cancellation Policy

Cancellation of orders

a. Orders can be cancelled up to 5pm two working days before the day selected by a customer for delivery. Cancellations are not accepted by telephone. The company can be contacted for this purpose either by email (info@emeraldlawns.ie), or recorded delivery to 45 Point Road, Limavady BT49 0LP. If orders are cancelled in this way, the turfgrass and any other products ordered will not be despatched to the customer and the company will refund the customer for the order price paid in full, less an administration charge of £15 or €20.

b. If a customer wishes to cancel an order before the day and time agreed for delivery but with less than two working days’ notice, the company will endeavour to prevent delivery of turfgrass or other products to the customer, however this may not be possible. Any refund will be made at the discretion of the company, to the customer, but less any costs incurred by the company in trying to satisfy the customer’s order prior to cancellation.

c. If a customer receives other products (excluding turfgrass) from the company but is not satisfied with the quality of the goods supplied, the customer has the right to return the goods in their original condition to an address agreed with the company within 28 days of placing the original order. The company should be notified in writing immediately of a customer’s intention to return goods. The products should be returned in the condition and packaging in which they were originally supplied and at the cost of the customer. Upon receipt of the goods in satisfactory condition, the company will refund the customer as soon as possible to their original payment method. Customers should note that the products remain their responsibility until they are received back to the company.

d. Turfgrass received by the customer as ordered and in good condition can not be returned by the customer to the company for a refund. This is because the short “shelf life” of turfgrass being perishable goods would make the product unsuitable for resale by the company.

Return of defective or damaged products

a. Any defects, discrepancies, damage or any other issues must be documented by the customer on the "proof of delivery" form (failure to do so will invalidate any potential claim), and then the customer or their representative (an adult - 18 years old or more) should contact the company by email sent to info@emeraldlawns.ie  within 24 hours of the delivery. If turfgrass or other goods received are damaged or defective in any way (and that has been determined and accepted in writing by the company), then the company will at their discretion either refund the applicable price paid by the customer to the company or provide replacement products, however the original goods may need to be returned to the company (at the customers expense) or other evidence supplied by the customer, which the company accepts as evidence, in order for a customer to receive a refund or replacement. Contact should be made by email within 24 hours of receipt of turfgrass to info@emeraldlawns.ie and in writing / email within 7 days for any other products supplied.

Products other than turfgrass

a. Products other than turfgrass should be returned in their original packaging and in the condition in which they were received by the customer and at the customers expense to an address advised with the company 

b. These returns must be made within 28 days of delivery of goods.
