These terms and conditions set out the basis on which you buy from us and we sell to you turf, topsoil and lawn products through this website. When you buy turf and products through Emerald Lawns' website, you enter a legally binding agreement with us. You should read these terms and conditions in full because they affect your rights and liabilities.
1) Definitions and basis of sale
a. In these terms and conditions, the following definitions apply:
Emerald Lawns (Ireland) Ltd (Company number NI043956) is referred to as “the company”. Registered & correspondence address: 45 Point Road, Limavady BT49 0LP
A customer buying turf and products through emeraldlawns.ie or Emerald Lawns (Ireland) Ltd is referred to as “the customer”. Delivery means delivery by the company or any subcontractor employed by the company directly or indirectly.
b. Any placement of an order by the customer via emeraldlawns.ie signifies the customer’s acceptance of these terms and conditions in full.
c. These terms and conditions can only be varied by a Director of the company in writing.
2) Ordering and payment
a. Turf and Topsoil prices quoted on emeraldlawns.ie include delivery to the address and county specified by the customer and VAT. If the address provided subsequently proves to be incorrect, e.g. in a different county to that specified by the customer, an additional charge of £50 or €70 per pallet will be made for a rescheduled delivery and we cannot accept responsibility for any deterioration in the quality of perishable goods due to this rescheduled delay.
b. Payment must be made in full by the customer at the time of ordering any turf and products via credit or debit card.
c. Orders must be placed on emeraldlawns.ie by 10am on the day preceding the working day the customer requires turf and products to be delivered, or earlier. Delivery is not available on Saturdays or Sundays, Mondays and certain other days as notified by the company.
d. Any order amendments must be made by 5pm two working days before the day selected by a customer for delivery. Amendments are not accepted by telephone. The company can be contacted for this purpose either by email (firstname.lastname@example.org), or recorded delivery to 45 Point Road, Limavady BT49 0LP. Any increase in price will be charged in addition to an administration charge of £15 or €20.
Orders can only be accepted by the company where there is adequate safe access for delivery to the address specified by the customer as determined by the sole discretion of the delivery driver. In the absence of such access, the company reserves the right to refuse or cancel orders without notice.
e. Advice and information given by the company relating to the characteristics and suitability of its products for particular applications is for guidance only, and accordingly no warranty is given, whether express or implied, as to quality or fitness for purpose.
f. The company has a policy for cancellation of orders, as detailed below.
3) Turf supplied
a. All turf supplied will be cultivated turf, which has been sown and maintained to produce a strong, healthy sward. Measures will be taken by the company during the growing period to control weeds, diseases and pests. The turf can not be guaranteed free of Poa annua (annual meadowgrass) as this species can come in to turf at any time through seeds borne on air as well as in soil. Turf, as a natural and growing product, will also be subject to some variation and so absolute consistency within and between orders can similarly not be guaranteed.
b. For turf supplied to form a successful new grass area, the customer will need to follow the company’s advice set out on emeraldlawns.ie for preparing the site on which the turf is to be laid, and then for laying and maintaining the turf thereafter. Any complaints by the customer (see section 6 below) will be invalid if this advice is not followed in full.
c. Turf supplied is at the customer’s risk from the time of delivery. After this time, the company will have no further liability for the turf or for any loss or damages connected with its use.
d. The company may vary the seed mixtures used to grow turf sold via emeraldlawns.ie. Where such variation does not materially affect the suitability of turf for indicated uses, such variation will not constitute grounds for any claim by the customer.
e. The size, weight and measure of turf rolls quoted on emeraldlawns.ie may vary due to turf being a natural product.
4) Topsoil and lawn products supplied
a. Topsoil and lawn products will be sourced only from reputable national suppliers with the aim always of supplying high quality.
b. Topsoil, being a natural product, will be subject to variation in particle shape, size and colour.
c. Many of the lawn products supplied will be subject to manufacturers’ guarantees. If products do not come with such a guarantee, then Emerald Lawns (Ireland) Ltd. will warrant their quality and specification.
d. Topsoil and lawn products supplied are at the customer’s risk from the time of delivery. After this time, the company will have no further liability for the products or for any loss or damages connected with their use.
a. The customer, or his/her representative (an adult - 18 years old or more) must be present at the delivery address on the selected date between the hours of 8am to 6pm to receive and sign the proof of delivery form for turf and/or other products supplied, In the event that this is not the case, delivery will not be made, an additional charge of £50 or €70 per pallet will be made for a rescheduled delivery and the company cannot accept responsibility for any deterioration in the quality of perishable goods due to this rescheduled delay. That is, unless agreed otherwise at the point of order, whereby we cannot accept any responsibility in relation to the damage of goods and/or any shortages of quantities delivered.
b. Delivery of palletised products, for instance turf and topsoil, will be on a kerbside basis to the address specified by the customer in an accepted order. It is up to the customer to move turf and/or products from kerbside to the position where they are to be used. Other products will be delivered by post or courier to the customer’s door.
c. The company will endeavour at all times to deliver turf and products on the date specified by the customer in an accepted order. Where, however, due to circumstances beyond the company’s reasonable control, delivery is delayed, the company will not be liable for any damages resulting, nor will this be accepted as grounds by the customer to cancel the order
d. In order to make deliveries, the company will need good safe access for large delivery vehicles with a tail lift and a manually operated pallet truck. This pallet truck will only run on smooth (non-gravelled), solid, level surfaces and therefore we can only guarantee a "kerbside" delivery, if access allows as determined by the sole discretion of the delivery driver. Deliveries are made to the closest access point to the property from the road as determined solely by the delivery driver. N.B. If the driver is instructed to access onto private property and they consent, we cannot accept any responsibility for any resultant damage caused to the property. Please note we are unable to physically carry goods e.g. up paths or to rear gardens.
e. The company will not accept liability for damages or injury caused to property or persons during delivery. It is the responsibility of the customer to alert the company to potential access difficulties at the point of order so that the company can assess whether an order can be accepted. If an order has been placed by the customer and then normal delivery is found to be impossible for reasons which were not specified on emeraldlawns.ie at the time of order, the company will try to make the delivery in another way or at another time, at an additional charge of £50 or €70 per pallet. If, in our opinion, the delivery is not possible, the delivery will be abandoned and the company reserves the right to cancel the order. This will be confirmed by the company by email. No refund will be made.
6. Any problems
a. The company’s aim is always to give complete satisfaction to the customer. However the customer must inspect & check the goods before accepting delivery. Any defects, discrepancies, damage or any other issues must be documented by the customer on the "proof of delivery" form (failure to do so will invalidate any potential claim), then he/she should contact the company by email to email@example.com within 24 hours of delivery.
b. If turf or other goods received are damaged or defective in any way, then emeraldlawns.ie will refund the customer or provide replacement products. Goods may need to be returned or other evidence, as accepted by the company, supplied in order for a customer to receive a refund or replacement. Please refer to the company’s Returns and Cancellation Policy below.
c. In the event of goods supplied being damaged or defective or in the event of other complaint, the company’s liability will not extend to consequential damage.
d. The company will not be responsible for any defects in turf supplied arising from inadequate site preparation, laying or maintenance of the turf by the customer.
e. The company will not be responsible for any failure of a product to meet its specification or to perform as it should due to manufacturers’ instructions not being followed in full.
These terms and conditions will be governed by Northern Irish law and any disputes will be resolved by the Northern Ireland courts.
Returns and Cancellation Policy
Cancellation of orders
a. Orders can be cancelled up to 5pm two working days before the day selected by a customer for delivery. Cancellations are not accepted by telephone. emeraldlawns.ie can be contacted for this purpose either by email (firstname.lastname@example.org), or recorded delivery to 45 Point Road, Limavady BT49 0LP. If orders are cancelled in this way, the turf and products ordered will not be despatched to the customer and emeraldlawns.ie will refund the customer for the order price paid in full, less an administration charge of £15 or €20.
b. If a customer wishes to cancel an order before the day and time agreed for delivery but with less than two working days’ notice, the company will try to prevent delivery of turf or other products to the customer. Any refund will be made at the discretion of the company, to the customer, but less any costs incurred by the company in trying to satisfy the customer’s order prior to cancellation.
c. If a customer receives topsoil or other lawn products (excluding turf) from the company but is not happy with the goods supplied, the customer has the right to return the goods to an address agreed with the company within 30 days of placing the original order. The company should be notified immediately of a customer’s intention to return goods. The products should be returned in the condition and packaging in which they were originally supplied and at the cost of the customer. On receipt of the goods in satisfactory condition, emeraldlawns.ie will refund the customer. Customers should note that the products remain their responsibility until they are received back to the company.
d. Turf received by the customer as ordered and in good condition can not be returned by the customer to the company for a refund. This is because the short “shelf life” of turf would make the product unsuitable for resale by the company.
Return of defective or damaged products
a. If a customer receives turf, topsoil or lawn products which are not as ordered or are defective or in any way damaged, then the customer should document the details on the "proof of delivery" form (failure to do so will invalidate any potential claim) and then contact emeraldlawns.ie to arrange to return the goods, if appropriate, and to receive a refund or replacement. emeraldlawns.ie can be contacted for this purpose by email (email@example.com). Contact should be made within 24 hours of receipt of turf and within 7 days for any other product.
Topsoil and lawn products
b. Topsoil or lawn products should be returned to an address agreed with the company in their original packaging and in the condition in which they were received by the customer.
c. Returns must be made within 28 days of delivery of goods.
